Procedure for dealing with complaints related to illegal content

The Council shall register complaints relating to illegal content within five working days of their receipt and shall notify the complainant thereof, normally in the same way as the complaint was received. 

The Council shall initiate proceedings to prevent the dissemination of illegal content on a content-sharing platform or through a content service not requiring authorisation under the Media Services Act   if, after reviewing the complaint, the Council concludes that the content is potentially illegal, the dissemination of which may endanger the public interest or constitute a significant interference with the individual rights or legitimate interests of a person within the scope of the legal order of the Slovak Republic and, at the same time, the content service provider has been demonstrably informed of the existence of the potentially illegal content through their own mechanisms designed for that purpose, and, if there are none, by other appropriate means, and the content service provider has not, 

  • within two days of the receipt of this information, informed the person who provided the information how they will deal with the situation, 
  • has not removed the potentially illegal content in question within five days of the receipt of this information, 
  • or has notified the person who provided the information that they will not remove the potentially illegal content in question. 

If it is proven in the procedure for the prevention of illegal content that the content in question constitutes illegal content and, at the same time, its dissemination endangers the public interest or constitutes a significant interference with the individual rights or legitimate interests of a person within the scope of the legal order of the Slovak Republic, the Council shall issue a decision on the prevention of the dissemination of illegal content, by which it shall order the provider of the content sharing platform or the provider of a content service not requiring authorisation under the   Media Services Act  to remove the illegal content in question and to prevent further dissemination thereof. The Council shall communicate the issuance of such a decision via its website or by other appropriate means.

If the Regulator does not initiate proceedings to prevent the illegal content and does not file the complaint related to the illegal content, they shall declare the complaint unfounded and notify the complainant thereof.
