Protection of personal data when submitting complaints

Pursuant to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

The personal data of natural persons (hereinafter also referred to as "Data Subjects"), provided for in the complaints related to a request for review or illegal content, are processed by the Council for Media Services with a registered office at Palisády 36, 811 06 Bratislava, ID No.: 30 844 151 (hereinafter also referred to as the "Controller").

The purpose of the processing of personal data when submitting complaints related to a request for review and complaints concerning illegal content is the processing of personal data of the data subjects mentioned within the said complaints delivered to the controller and personal data related to the handling of these complaints.

In both cases, the legal basis for the processing of personal data is the fulfillment of the legal obligations of the controller (Act No 264/2022, Media Services Act) and the fulfillment of tasks carried out in the public interest and in the exercise of public authority entrusted to the controller.

The recipients of the processed data are, in particular, courts, public prosecutor's office, law enforcement authorities, and other entities authorized by law.

The personal data of the data subject will be retained by the controller for a period of 10 years in the form of complaints related to a request for review, complaints related to illegal content, and complaints referred to other relevant authorities.

The controller shall not transfer the personal data of the data subject to third countries or international organizations. 

The processing of personal data of data subjects by the controller shall not involve profiling or automated decision-making concerning the rights and freedoms of data subjects.

Each data subject shall have the right, inter alia, to request the controller to:

  • access personal data concerning the respective data subject (Article 15 of the GDPR), 
  • rectify inaccurate personal data (Article 16 of the GDPR) or erase personal data ("right to be forgotten") (Article 17 of the GDPR) or restrict processing of personal data (Article 18 of the GDPR),
  • object to the processing of personal data (Article 21 of the GDPR),
  • receive its data according to the portability standards of personal data (Art. 20 GDPR Regulation),
  • lodge a complaint with a supervisory authority.

The provision of personal data for the above purposes is a legal requirement insofar as the personal data are processed for complaints submitted pursuant to articles 150 and 151 of the Media Services Act. The provision of personal data for these purposes is neither a contractual requirement nor a requirement necessary for entering into a contract with the controller. In the event that personal data is not provided, the controller may, but is not obliged to, process the submitted complaint (for example, an anonymous complaint).
